CBP Issues Updated Guidance and New Requirements

U.S. Customs and Border Protection (CBP) has confirmed a 90-day extension of the Jones Act waiver originally issued on March 17, 2026. 

The waiver now remains in effect through August 16, 2026, provided all covered cargo is loaded onto the vessel before the deadline.

This update may offer continued flexibility for eligible domestic movements on foreign-flag vessels, but it also introduces additional documentation requirements and reinforces existing reporting obligations.


What Changed

CBP’s latest guidance includes several key updates:

  • Extended Deadline:
    Cargo must be loaded by 11:59 PM EDT on August 16, 2026
  • Updated Product List:
    CBP released a revised list of potentially covered commodities as of April 24, 2026. Download the list.
  • New Documentation Requirement:
    PDF copy of CBP Form 1302 (Inward Cargo Declaration) must now be included with initial notification

Required Notification to CBP

Parties operating under the waiver must notify CBP at jonesact@cbp.dhs.gov and provide:

  • Vessel name (including IMO number and flag)
  • Commodity and applicable HTS code
  • Carrier details
  • Ports and dates of departure and arrival (including CBP port codes)
  • PDF copy of CBP Form 1302

Vessel Entry and Reporting Still Apply

Even under the waiver, standard vessel requirements remain in place.

Foreign-flag vessels must:

  • File formal entry through ACE using the Vessel Entrance and Clearance System (VECS)
  • Comply with reporting requirements under 19 CFR Part 4

Incomplete or incorrect documentation may result in additional CBP follow-up.
