
Back on May 28th, 2024, the Office of the US Trade Representative (USTR) announced it would develop a temporary exclusion process from Section 301 duties for specific types of machinery used in domestic manufacturing. As of October 15th, the US Trade Representative has now started accepting those requests for temporary exclusions. The window to submit exclusion requests will end on March 31st, 2025.
To summarize the details:
• Each request must contain specific information:
10-digit HTSUS number
a detailed description
the rationale and any necessary data to support the exclusion request
• USTR will then evaluate your request for validity with responses dues in about a month, posted on the USTR’s portal
• There is then a 15-day feedback/reply period
• Granted exclusions take effect from the date the exclusion determination is published in the Federal Register
