The U.S. Department of Homeland Security (DHS) recently announced the release of the updated Uyghur Forced Labor Prevention Act (UFLPA) Entity List. This consolidated register contains four lists mandated by the UFLPA, which aims to prevent the importation of goods produced with forced labor from the Xinjiang region in China. The latest update includes the addition of two entities and eight subsidiaries involved in activities related to forced labor and persecution in Xinjiang. In this blog post, we will provide an overview of the UFLPA Entity List and discuss the significance of the newly added entities.
Understanding the UFLPA Entity List
The UFLPA Entity List is a compilation of four distinct lists specified under the UFLPA. These lists are designed to identify entities engaged in various practices related to forced labor and human rights violations in Xinjiang. The four lists are as follows:
- List of entities in Xinjiang involved in mining, production, or manufacturing of goods with forced labor.
- List of entities working with the Xinjiang government to recruit, transport, transfer, harbor, or receive forced labor or individuals from persecuted groups.
- List of entities that export products made by entities in the first two lists from the People’s Republic of China (PRC) to the United States.
- List of facilities and entities, including the Xinjiang Production and Construction Corps, sourcing materials from Xinjiang or entities associated with the government-labor schemes involving forced labor.
The UFLPA Entity List aims to serve as a comprehensive reference for enforcing the UFLPA’s provisions.
New Additions to the UFLPA Entity List
The most recent update to the UFLPA Entity List includes the addition of two entities and eight subsidiaries linked to forced labor practices in Xinjiang. These entities have been implicated in activities such as recruiting, transporting, transferring, harboring, or receiving forced labor or individuals from persecuted groups. The newly added entities are as follows:
- Xinjiang Zhongtai Chemical Co. Ltd.
- Ninestar Corporation and its eight Zhuhai-based subsidiaries:
- Zhuhai Ninestar Information Technology Co. Ltd.
- Zhuhai Pantum Electronics Co. Ltd.
- Zhuhai Apex Microelectronics Co., Ltd.
- Geehy Semiconductor Co., Ltd.
- Zhuhai Pu-Tech Industrial Co., Ltd.
- Zhuhai G&G Digital Technology Co., Ltd.
- Zhuhai Seine Printing Technology Co., Ltd.
- Zhuhai Ninestar Management Co., Ltd.
The inclusion of these entities on the UFLPA Entity List signifies their involvement in activities related to forced labor and the mistreatment of Uyghurs, Kazakhs, Kyrgyz, and other persecuted groups in Xinjiang.
Enforcing the UFLPA
Under the UFLPA, entities listed on the UFLPA Entity List are subject to a rebuttable presumption that goods produced by them involve forced labor. This presumption prohibits the importation of such goods into the United States. This enforcement mechanism helps ensure that companies engaged in human rights abuses face consequences for their actions.
The FLETF, or Forced Labor Enforcement Task Force, which includes various U.S. government agencies, oversees the implementation and revision of the UFLPA Entity List. The FLETF may review and vote on revisions, including additions, removals, or technical corrections, based on the criteria outlined in the UFLPA.
The updated UFLPA Entity List provides valuable information on entities involved in forced labor practices and human rights violations in Xinjiang. The recent additions to the list highlight the ongoing efforts to identify and hold accountable those entities that engage in such practices. By leveraging the UFLPA and the Entity List, the U.S. government aims to prevent the importation of goods produced through forced labor and promote fair and ethical trade practices.
