Trump Signs EO Removing Reciprocal Tariffs on New Products Effective 12:01am ET Nov 13 – 33

President Trump has signed a new Executive Order (EO) that further modifies the scope of products subject to the reciprocal tariffs established earlier this year.

What’s happening

The latest EO removes certain agricultural and other products from the tariff list and updates multiple tariff annexes that guide how duties should be assessed going forward.  These changes take effect for goods entered or withdrawn for consumption on or after 12:01 am EST on November 13th, 2025.

According to the EO, the Administration reviewed recommendations from federal agencies monitoring the declared national emergency related to the US goods trade deficit as well as current domestic supply, demand, and production capacity for various products. Based on this review, the President determined it was necessary to modify which goods remain subject to the reciprocal tariff program.

Key points from the Order

  • The list of products is extensive – you can view the updated versions of Annex I and Annex II here
  • The list contains specific 8-digit HTS codes identifying the products covered by this amendment.  Included are produce and produce products, nuts and legumes, coffee, tea, spices, grains, chemicals and minerals
  • The Harmonized Tariff Schedule will be modified as specified in Annex I of the new order
  • Duty refunds, where applicable, will follow standard CBP procedures
  • Commerce, DHS, and USTR have been directed to take all necessary actions — including regulations or operational guidance — to implement the updated tariff scope
  • Agencies will continue monitoring conditions tied to the national emergency and may recommend future adjustments
  • Note: appropriate IEEPA tariffs still apply
