In a recent Federal Register notice dated September 6, 2023, the Office of the U.S. Trade Representative (USTR) made a significant announcement regarding the extension of existing China 301 exclusions. These exclusions, originally set to expire on September 30, 2023, have now been extended until December 31, 2023.
There are two key sets of exclusions under consideration. The first set comprises the 77 exclusions that pertain to COVID-related matters. You can refer to the list of these exclusions, identified by their extension date of September 30, 2023, in heading 9903.88.68 and Chapter 99, subchapter III U.S. notes 20(uuu)(i), (ii), (iii), and (iv). These exclusions have played a crucial role in mitigating the impact of the pandemic on trade.
The second set encompasses 352 exclusions that were reinstated and subsequently extended by the USTR. These exclusions can be found in heading 9903.88.67 and Chapter 99, subchapter III U.S. notes 20(ttt)(i), (ii), (iii), and (iv). The decision to extend these exclusions reflects the USTR’s commitment to maintaining a balanced trade environment.
These actions have been taken primarily to facilitate a transition period for the exclusions set to expire and to enable further deliberation within the ongoing four-year review of the comprehensive China 301 program. It is essential to note that all other expired China 301 exclusions remain inactive and without effect.
