EO Issued for China Tariff Deal – 31

The White House has issued the executive orders confirming the previously announced adjustments to the fentanyl-related IEEPA tariff rate on certain China-origin goods and the reciprocal tariff deal struck last week by Presidents Trump and Xi.

Key Points in the Fentanyl-Related IEEPA Tariff

  • The additional tariff rate will be reduced from 20% to 10%, effective November 10th, 2025.  The change will apply to entries entered for consumption or withdrawn from warehouse on or after 12:01 AM ET, November 10th, 2025
  • This applies to goods currently subject to the 20% rate under Executive Order 14195, as amended
  • The Harmonized Tariff Schedule (HTSUS) will be updated to reflect the new 10% rate under heading 9903.01.24
  • US agencies (including DHS and CBP) will continue to monitor China’s implementation of its commitments related to reducing fentanyl precursor exports
  • If China does not follow through on these commitments, the tariff rate may be reconsidered or increased in the future
  • No other tariff programs (e.g. Section 301) are changed by this order. These may still apply in addition to the adjusted IEEPA rate

Key Points in the Reciprocal Tariff EO

  • The previously announced heightened reciprocal tariffs on imports from China will remain suspended for an additional period
  • The suspension will remain in effect until 12:01 a.m. Eastern Time on November 10th, 2026
  • During this period, imports from China will continue to be subject to the 10% reciprocal tariff rate, rather than the previously authorized higher rate
  • China has committed to:
    • Suspend or eliminate export controls on rare earth elements and other critical minerals
    • Remove or pause retaliatory tariffs on US agricultural products (including soybeans, sorghum, and logs)
    • Address measures taken against US semiconductor companies
    • Extend its market-based tariff exclusion process for US imports until November 10th, 2026
  • US agencies will monitor China’s compliance. If China does not follow through, the suspension may be revisited

Looking Ahead: IEEPA Tariff Review
