
As the U.S. government shutdown continues, Alba is closely monitoring developments with US Customs and Border Protection (CBP) and Partner Government Agencies (PGAs). Here’s what you need to know right now:
What’s Operating Normally:
- CBP Core Functions: Permits, corporate permits, FTZ/bonded warehouse activations, ACE system support, agriculture inspections, and revenue/penalty processing are continuing without interruption
- Cargo Clearance: Entries are being processed, and CBP retains the “toolbox” to address PGA holds via conditional release or direct contact with agencies
- Trade Enforcement: Programs such as the Trade Remedy Branch, EAPA, and duty assessments remain active
- Broker Exams & Permits: The Customs Brokerage License Exam is still scheduled, and broker permits are processed as usual
Where You May See Delays:
- Partner Government Agencies: Some PGAs (FDA, USDA, TTB, etc.) may be operating with limited staff. Importers of food, agriculture, alcohol, and other regulated goods should anticipate possible delays
- TTB (Alcohol Imports): The Alcohol and Tobacco Tax and Trade Bureau is furloughed, which may impact COLA waiver processing
- Refunds: While CBP is processing them, actual issuance may be delayed depending on Treasury operations
- Tariff Updates: Uncertainty remains about Harmonized Tariff Schedule (HTS) updates during the shutdown. Importers should double-check classifications
- Overtime at Ports: Overtime is authorized but handled locally—perishable or urgent shipments should have availability confirmed directly at the port
Policy Watch
- AGOA Expired: The African Growth and Opportunity Act (AGOA) has lapsed. Imports no longer receive duty-free benefits until renewal. CBP does not allow retroactive processing
Bottom Line: Cargo continues to move, and CBP remains operational. The biggest risks for importers are delays at PGAs, refund issuance, and tariff update timing. We recommend planning additional lead time for regulated goods and monitoring agency guidance closely.
