Additional information regarding the below notice – We have been informed that due to the government shutdown, US Customs will be unable to process Section 301 exclusions due to the programmers that update HTS codes being currently furloughed. No action can be taken until after the government shutdown has concluded and US CBP is back at full staffing.
In a notice published 12/28/2018 in the Federal Register, the US Trade Representative has published a list of excluded tariff numbers and products from the “List 1” of Chinese imported products, which have been subject to 25% additional duties.
Perhaps most importantly, the effective date of this exclusion is July 6, 2018; so importers who have paid additional duties on excluded products already imported will be eligible for duty refunds. In the coming days, Alba Wheels Up will be examining impacted entries for potential customer duty refunds.
Please reference the notice in the Federal Register located at https://www.federalregister.gov/documents/2018/12/28/2018-28277/notice-of-product-exclusions-chinas-acts-policies-and-practices-related-to-technology-transfer to review the affected tariff codes and products.
